We, company “_____”, in the person of ______________, hereby state and represent with full cor-porate authority and responsibility that we are ready, willing and able to irrevocably purchase the following commodity as per the terms, conditions, specifications, quantity, and price stated below. We hereby confirm that under signature below verify that we have the financial capability to complete the purchase.
Product: Nigerian crude oil – BLCO
Quantity: 6,000,000 bbl/months
Terms: Crude Oil in China (SPOT) Onshore Tanks "Ex-Tank" Free Trade Zone Port in China Tank SS NOBLE II OFF SHORE TANKS
Price: Price will be based on Platt’s oil gram price report of Brent crude oil pricing for time of delivery (as mutually agreed upon) discount to the buyer is USD$3.00 China Tanks.
Procedure:
1. Seller and buyer sign contract and buyer return signed contract with ATB format.
2. Shipment / delivery: Delivery basis of the cargo sold under this contract shall be offshore tank products. Seller shall nominate vessel for terminal schedule/offshore tank discharge and the buyer shall nominate her representative (Supercargo or Inspector) to confirm cargo on TANK FARM while buyer raises a conditional payment instrument MT103/ 72 for the cargo to be doc-umented in buyer’s name.
3. Seller issue available POP including recent TANK RECEIPT for Buyer’s due diligence.
4. Buyer or its end Buyer swift MT103/72 conditional payment to the Seller’s bank account to receive DIP TEST AUTHORIZATION FOR A TANK FARM plus a complete set of all of the following documents:
1) One (1) original and three (3) copies of Performa commercial invoice.
2) One (1) full set of three (3) original and non-negotiable copies of Bill of Lading showing the Buyer as the consignee
3) One (1) original and three (3) copies of certificate of quantity of loading port
4) One (1) original and three (3) copies of certificate of quality of loading port
5) One (1) original and three (3) copies of certificate of origin
6) One (1) original and three (3) copies of master's receipt of cargo samples
7) One (1) original ULLAGE report issued at loading terminal
8) One (1) Certificate of Authenticity) original and three (3) copies of the cleanliness report at the loading port
9) One (1) original and three (3) copies of Cargo Manifest
10) One Copy of Platt's indication from CI date (for loaded vessels already in the port of discharge) to support the invoice value
11) ATS
12) Any other document pertaining or related to this transaction duly signed by authorized person(s) or as required by as specified in any bank instrument
5. NNPC issues ATS in the name of the Buyer and the Buyer’s consignee upon confirmation of MT 103/72 at the same time as the above documents.
6. Upon the Seller’s bank confirmation of MT 103/72, Seller arranges for NNPC to issue DTA for the tank farm product.
7. Seller permits Buyer and its inspectors to carry out dip test in the tank farm. The buyer’s inspector e-mails the Quantity/Quality (Q and Q) report to the seller and its bank.
8. Seller issues final invoice to the buyer. Buyer effects payment of the invoice within 24 hours by MT103 or T.T.
THE QUALITY OF THE PRODUCT SHALL BE PURSUANT TO NNPC OFFICIAL TECHNICAL SPECIFICATION (APPROVED EXPORT GRADE) OF NIGERIA LIGHT CRUDE OIL, NIGERIA ORIGIN.
